APARTMENT RULES PUSTELNIA SZYMONKA

§1. General provisions

  1. These regulations define the rules for using the Pustelnia Szymonka apartment (hereinafter referred to as the “Apartment”) and the adjacent area and infrastructure (hereinafter referred to as the “Property”), located at Szymonka 131, 11-520 Szymonka.
  2. The Lessor is the owner of the Apartment, Krzysztof Wasilewski, conducting business activity under the name Prime Auditors & Accountants Krzysztof Wasilewski, with its registered office in Warsaw, 00-193, ul. Stawki 4A lok. 7, NIP 6571133482, email: recepcja@pustelniaszymonka.pl, tel. +48 508 047 511 (hereinafter referred to as the ‘Owner’ or ‘Landlord’).
  3. The lessee is an adult guest of the apartment who has entered into a Lease Agreement with the Lessor, together with accompanying persons (hereinafter referred to as the “Guest” or “Lessee” or “Client”).
  4. The regulations apply to all Guests and accompanying persons.
  5. Making a reservation (including through Booking.com or other booking platforms) is tantamount to accepting the Regulations.
  6. The apartment is rented for short-term purposes only.

§2. Reservation, conclusion of the lease agreement and accommodation

  1. Reservations can be made electronically, via a booking platform, e.g. Booking.com (hereinafter referred to as the “Booking Platform”), or directly with the Owner via the website pustelniaszymonka.pl (Hotres booking system), by phone, email or other communication channel (e.g. text message, etc.). The lease agreement is concluded upon confirmation of the reservation by the booking platform, or by the Owner in other cases.
  2. The terms of payment, cancellation of reservations and refunds are determined by the booking platform, and in the case of direct bookings, by the Owner.
  3. Reserving the Apartment requires a deposit of 100% of the total value of the reservation.
  4. In the case of reservations made in a manner other than through the booking platform, the reservation shall be confirmed by the person making the reservation within 48 hours by paying a deposit in the form of: a bank transfer directly to the account indicated in the booking process, or via the Pay Now payment gateway or other similar systems, with the proviso that not all of the above payment methods may be active at any given time. If the deposit is not paid within the specified time limit, the preliminary booking is automatically cancelled. The deposit is forfeited in full if the customer cancels the booking 30 days or less before the first day of the booking period. The deposit shall be refunded in full if the service is not provided for reasons attributable to the Owner.
  5. No later than 3 days before arrival, the Client will be sent an email with information about the registration form, which must be completed and sent by the Client in the manner indicated in the correspondence no later than 1 day before the start of the lease. Failure to complete the registration form on time on the day of arrival may result in a lack of access to the Apartment. As part of the reservation process, it is required to provide the first name and last name, address of residence, identity document number, telephone number and e-mail address of the person making the reservation, as well as the first names and last names of other Guests. Upon check-in, the Guest is obliged to present an identity document.
  6. The hotel day starts at 4:00 PM and ends at 11:00 AM.
  7. One day in advance, the Client should specify the approximate time of arrival by phone or SMS at 508 047 511.
  8. The Guest should report any possible deficiencies, defects and reservations regarding the technical condition of the Apartment on the day of check-in, in the form of SMS or email communication. Failure to report any comments in this regard on the day of check-in is tantamount to accepting that the Apartment, together with its equipment, has been made available in a condition that does not raise any comments or reservations from the Guest.
  9. During check-in, an appropriate local (climate) fee is collected in cash in accordance with the rate applicable in the Ryn commune.
  10. The Apartment can accommodate a maximum of 6 people at the same time, and the number of Guests may not exceed the number of people indicated in the reservation. It is forbidden for unregistered persons to stay in the Apartment. If unauthorized persons are found to be staying in the Apartment, the Owner will charge the guest a contractual penalty of PLN 1,000 for each unauthorized person per day.
  11. Minors may stay in the apartment only in the company of their adult guardians.
  12. The Guest’s earlier departure for reasons beyond the Owner’s control does not entitle him to demand a refund for the unused service.
  13. Earlier check-in or later check-out is possible after consultation with the Owner.
  14. Failure to leave the Apartment at the agreed time will result in a charge for an additional day.
  15. In the event of sudden events of force majeure, defects or other random events, especially causing that the personal safety of the Guest or his property, for reasons beyond the Owner’s control, cannot be guaranteed, the Owner reserves the right to cancel or shorten the reservation and refund the funds for unused nights.

§3. Use of the Apartment and the Property

  1. The Guest is obliged to use the Apartment and the Property in accordance with their intended purpose.
  2. It is forbidden to organize parties, receptions or social events in the Apartment and on the Property.
  3. Smoking tobacco products, also in electronic form, is strictly and completely prohibited throughout the building in which the Apartment is located. If the smell of the above-mentioned is detected, the Owner will charge the Guest a contractual penalty of PLN 2,000.
  4. Quiet hours are from 11:00 PM to 7:00 AM.
  5. The Guest is obliged to respect the peace of the neighbours.
  6. In accordance with fire safety rules, it is forbidden to use devices that are not part of the apartment’s equipment, e.g. own heaters and electric heaters. The Guest is obliged to comply with the rules of safe use of electrical appliances in the Apartment, e.g. iron, induction hob, etc., remembering to turn them off each time before leaving the Apartment or going to rest.
  7. For safety reasons, each time the Guest leaves the Apartment, he should make sure that the doors and entrance gates to the building in which the Apartment is located are locked.
  8. The Guest is fully responsible for damage to the Apartment or its equipment and to other parts of the building in which the Apartment is located, as well as to the infrastructure and equipment of the Property, not resulting from normal use, caused by the Guest and by persons to whom the Guest has in any way made the Apartment or Property available for use or stay on their premises. The Guest’s liability also applies to damages caused to third parties on the premises of the Apartment or Property.
  9. Greater than normal consumption of towels resulting in their destruction is subject to an additional fee of PLN 50 per piece.
  10. The Guest is obliged to immediately inform the Owner of any defects, damage or damage caused by him and persons to whom he has in any way made the Apartment or Property available for use or stay on their premises.
  11. The Owner reserves the right to charge an additional cleaning fee if the apartment is left in a condition significantly deviating from the norm, including extreme dirt on floors, countertops, furniture or accumulation of a large amount of garbage. The amount of the fee will be adequate to the amount of work and time needed to restore the apartment to its proper condition, and will be based on photographic documentation prepared by the cleaning service.
  12. The Owner may collect a refundable deposit to secure any obligations of the Guest for damages caused. Information in this regard is always included in the lease offer.
  13. The apartment service has the right to enter the rented Apartment without the Guest’s permission if it becomes aware of any threats to the safety of Guests or property.
  14. The Guest is obliged to keep the Apartment and the Property with its infrastructure clean in a condition adequate to normal use. All necessary equipment and cleaning agents are provided in the Apartment.
  15. The Guest is fully responsible for the keys to the Apartment and the remote controls for the entrance gates entrusted to him. Loss of a key or remote control is subject to an additional fee of PLN 200 per item.
  16. The Guest may store his own equipment (bicycles, sports equipment, etc.) in the storage room. Before placing equipment, both his own and rented from the Owner, in the storage room, it should be dried and cleaned, especially of mud, sand, etc., to a degree that ensures that the storage room is kept clean.
  17. If the Guest is provided with a storage room and a garage hall, it is strictly forbidden to open cabinets and other furniture located in these rooms and to in any way violate the equipment and equipment located there that is not intended for use by the Guest, as well as to enter other rooms connected to the storage room and garage hall.
  18. There are paved parking spaces on the Property for the Guest’s use. They should be used in such a way as not to block communication to the garage hall and other external parking spaces for other vehicles.
  19. The property and common areas are subject to 24-hour video surveillance. Monitoring does not include the interior of the Apartment.

§4. Pets

  1. Pets are allowed in the Apartment and on the Property, provided that they are reported and accepted by the Owner at the reservation stage and an additional fee is paid for this in accordance with the price list. If the presence of animals whose stay has not been reported is detected, the Owner will charge the Guest three times the rate for the animal for each day.
  2. In accordance with safety rules, we do not accept dog breeds considered aggressive, or any animals aggressive towards other animals and people.
  3. The animal’s stay is possible only if the Guests have its health record with current vaccinations and confirmation of deworming.
  4. The Guest is fully responsible for the behaviour of his animals and for any damage caused by them to the Apartment or its equipment and to other parts of the building in which the Apartment is located, as well as to the infrastructure and equipment of the Property. The Guest’s liability also applies to damages caused to third parties on the premises of the Apartment or Property.
  5. The Guest is fully responsible for cleaning the Property after his animals and keeping the Apartment clean in the event of their presence.

§5. Garden, garden furniture, grill and bonfire

  1. The garden can only be used for recreational purposes.
  2. It is forbidden to damage greenery and garden equipment. In particular, it is forbidden to drive motor vehicles on green areas, except for the paved parking area and driveway. In the event of a violation of the prohibition on driving motor vehicles on green areas, outside the paved parking area and driveway, the Owner shall charge the Guest a contractual penalty of PLN 2,000.
  3. Guests have at their disposal a set of garden furniture, which is stored in the warehouse, in the building where the Apartment is located. They should be used in accordance with their intended purpose, and after each use, they should be left clean in the warehouse.
  4. The use of the grill and bonfire is allowed only in designated places, while observing safety rules.
  5. It is forbidden to leave the fire or grill unattended, and before leaving them, the fire must be thoroughly extinguished.
  6. Only fuel intended for this purpose may be used for burning. It is forbidden to burn garbage, waste or hazardous materials.
  7. Minors may not be near a bonfire or a lit grill without the supervision of their adult guardians.

§6. Bathing area, fishing and mooring boats

  1. The Guest has at his disposal a floating pier that serves as a bathing area, fishing ground and place for mooring boats, which he can use for recreational purposes at his own exclusive responsibility.
  2. Minors may not be on the pier without the supervision of their adult guardians.
  3. The bathing area is not guarded.
  4. Fishing is allowed in accordance with applicable law, provided that the permits required by law are obtained.
  5. Mooring of a boat or other floating equipment by the Guest is possible only after prior agreement with the owner and payment of a fee in accordance with the current price list. All floating units should be moored in a way that does not expose the pier elements to damage.
  6. There is no infrastructure on the Property that allows launching or slipping floating units, therefore such activities are strictly prohibited. Launching your own floating units should only be carried out in nearby ports, marinas or other public places designated for this purpose.
  7. The pier is a place where waterfowl sit, which is associated with the risk of it being contaminated with bird droppings. Therefore, the Owner is unable to guarantee and does not guarantee the cleanliness of the pier surface.

§7. Rental of bicycles and water equipment and other equipment

  1. The Guest has the option of renting bicycles and water equipment (e.g. kayaks, SUPs) and other equipment (e.g. optical and night vision and thermal imaging binoculars) after prior agreement with the Owner and payment of a fee in accordance with the applicable price list.
  2. Minors may not use the rented equipment without the supervision of their adult guardians.
  3. The Guest is fully responsible for damage to the rented equipment, not resulting from normal use. The Guest’s liability also applies to damages caused to third parties.
  4. The equipment must be returned in an unimpaired, clean and dry condition.

§8. Sauna and gym

  1. The Guest uses the sauna and gym at his own risk, taking into account his health condition and medical indications in this regard.
  2. Minors may not be in the sauna and gym without the supervision of their adult guardians.
  3. Hygiene rules must be observed in the sauna, in particular, the entire body must be washed with soap in the shower before entering, and inside you should sit on towels in such a way that no part of the body touches the wooden surface.
  4. It is forbidden to enter the sauna in shoes or clothing.
  5. In order to avoid burns and body damage, do not wear jewellery, watches, glasses or contact lenses in the sauna.
  6. In the sauna, do not approach the stove or put anything on the stove to avoid the risk of fire.
  7. It is forbidden to bring dishes, eat food or alcohol or other intoxicants into the sauna and gym.
  8. After finishing using the sauna, remove all personal items from it and turn off the stove using the controller panel.
  9. In order to maintain hygiene in the gym, you should exercise in clean shoes intended for training and with a towel.
  10. The use of the sauna and gym may be subject to additional fees in accordance with the applicable price list.
  11. The Owner reserves the right to limit access to the sauna and gym.

§9. Access road

  1. Access to the Property and the Apartment is partly via a communal dirt road, which means that the road administrator, i.e. the Ryn commune, is responsible for its maintenance, snow removal and ensuring its pass ability.
  2. The Owner is not responsible for difficulties or damages resulting from the condition of the dirt road surface and the conditions prevailing on it.
  3. The Guest is obliged to adapt the vehicle and the way of driving to the condition of the dirt road and prevailing weather conditions.

§10. Complaints

  1. The guest has the right to lodge a complaint in the event of noticing deficiencies in the quality of the services provided.
  2. The complaint should be submitted in writing by e-mail to the following address: recepcja@pustelniaszymonka.pl, immediately after noticing deficiencies in the standard of services provided.
  3. The complaint should include the dates of the stay, the Guest’s contact details and a detailed description of the subject of the complaint. The Owner shall consider the complaint within 14 days of receiving it and shall provide information about the outcome of its consideration to the email address provided by the Guest in the complaint.

§11. Final provisions

  1. The owner reserves the right to publish rental offers that deviate from the rules set out in these terms and conditions, provided that any deviations are clearly specified in each rental offer that contains such a deviation.
  2. In matters not covered by the regulations, the provisions of the Civil Code shall apply.
  3. In the event of discrepancies between the interpretation of the Polish version and translations of the Regulations into other languages, the Polish version shall prevail.
  4. The court competent to resolve disputes is the court competent for the Owner’s registered office.
